Key Claimer — Creator Terms & Conditions
Last updated: 22 July 2026
Key Claimer is a creator activation platform operated by The Game Marketer (“Key Claimer”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) are the agreement between you (the “Creator”, “you”) and us. By creating an account, claiming a key, or joining a campaign, you agree to these Terms.
- You claim keys for upcoming games and, in return, you go live at least once with that game on your channel.
- You keep ownership of your content. We and the game's studio get a limited licence to use it in connection with the game and Key Claimer.
- No exclusivity. You're free to work with anyone else, on or off Key Claimer.
- Keys are for making content, not for keeping, selling, or giving away.
- Some campaigns are paid. Rates and requirements are shown before you join.
- Be honest with your audience and label sponsored content as required by law.
- We can pause or close accounts that break these Terms.
The full terms below are what actually applies. If anything conflicts, the full terms win.
1. Who can use Key Claimer
To use Key Claimer you must:
- be at least 18 years old (or the age of majority where you live);
- have the legal capacity to enter into this agreement;
- have a genuine, active content channel (e.g. Twitch, YouTube, TikTok, Kick, or similar); and
- give accurate account information and keep it up to date.
One account per person or entity. You're responsible for everything that happens under your account, so keep your login details secure and tell us straight away at influencer@thegamemarketer.com if you think someone else has accessed it.
2. What Key Claimer does
Key Claimer connects creators with game studios and publishers (“Studios”). Through the platform you can:
- browse and claim game keys for upcoming or released titles;
- join campaigns, some of which are paid; and
- receive briefs, assets, and other materials for those games.
We are an intermediary. We don't develop the games and we don't guarantee any particular outcome, view count, income, or that any specific key or campaign will be available to you. Your relationship with us and with Studios is that of an independent creator, not an employee, partner, or agent.
3. Claiming keys
When you claim a key, you agree to go live with that game at least once. Specifically, you agree to:
- go live at least once with the game, publicly, on your connected channel;
- do so within 30 days of claiming the key, or by any date stated in the campaign (whichever the campaign specifies);
- keep any resulting stream, VOD, or content publicly available for at least 30 days, unless the campaign says otherwise;
- respect any embargo or release date. Don't post or stream before the date we or the Studio give you; and
- follow the campaign brief and any reasonable Studio guidelines.
Keys are provided only so you can create this content. You must not:
- sell, trade, gift, auction, or publicly share keys or codes;
- claim keys you don't intend to actually stream; or
- claim more keys than you can realistically use.
If you don't go live as agreed, or if you misuse keys, we may (at our discretion) reclaim or deactivate the key, limit or pause your access to future keys and campaigns, and/or withhold any related payment. We may ask a Studio to revoke a key where it's been misused. We aren't liable for keys that fail to activate due to region locks, platform issues, or Studio errors. But tell us and we'll try to help sort it.
4. Paid campaigns
Some campaigns pay you. For those:
- The rate, requirements, platforms, and deliverables are agreed upon before you join. Joining means you accept them for that campaign.
- Payment is earned only when you complete the stated deliverables and meet the campaign requirements (for example, going live, posting required content, and keeping it up for the stated period).
- Unless a campaign says otherwise, payment is not conditional on hitting a specific number of views.
- We may verify your content and performance (including via public platform data and analytics) before releasing payment.
Payments and tax
Payouts are made through our payment provider to a bank account of your choice. Make sure your payout details are correct; we're not responsible for payments sent to wrong details you provided.
We may set a minimum payout threshold and a regular payout schedule, both shown in your dashboard. Amounts below the threshold roll over.
You are responsible for your own taxes. We don't withhold tax unless the law requires it. We may ask for tax information before paying you and may hold payment until we receive it.
If you're paid for content you later delete early, or for content obtained by breaking these Terms, we may reclaim that amount from current or future earnings or ban you from engaging in future campaigns over our platform.
5. Content standards and disclosure
Your content must:
- be your own original work and genuinely made by you;
- honestly represent the game with no faked footage or misleading claims;
- follow the campaign brief and any platform rules; and
- clearly disclose paid or incentivised content as required by law and platform policy (for example the UK ASA / CAP Code, the US FTC guidelines, and equivalents, using labels like “#ad”, “paid partnership”, or the platform's built-in disclosure tools).
Your content must not contain hate speech, harassment, discrimination, sexually explicit material, illegal content, or anything beyond the game's own age rating aimed at audiences it isn't suitable for. Don't personally attack Studio staff, other creators, or us.
We can remove content from the platform, and decline or withhold payment, where content breaks these standards.
6. Who owns what
You own your content. You keep all rights to the streams, videos, and clips you create. Nothing here transfers ownership to us.
By using Key Claimer, you grant:
- to us: a limited, non-exclusive, royalty-free licence to access, track, and reference your campaign content for operating the platform, verifying you met campaign requirements, measuring performance, and internal reporting;
- to the relevant Studio: a limited, non-exclusive licence to view and share your campaign content in connection with that specific campaign. Any wider use by a Studio (e.g. their own ads or store page) needs your separate agreement, arranged through the platform.
Studio materials (games, keys, logos, trailers, assets, embargoed info) stay the Studio's property. You get a limited licence to use them only for the campaign you claimed them for, and that licence ends when the campaign ends. Don't use them for anything else.
The Key Claimer and The Game Marketer names, logos, and platform are ours. Don't copy, scrape, reverse-engineer, or misuse them.
7. Confidentiality
You may see confidential information including unreleased games, embargoed builds, campaign rates, and briefs. Keep it private, don't share it outside the campaign, and respect all embargoes. Any specific NDA attached to a campaign applies on top of these Terms.
8. Things you must not do
Don't:
- inflate views or engagement using bots, click farms, paid views, or view-exchange schemes;
- create multiple accounts to get around limits or bans;
- impersonate anyone, or use false identity, payment, or tax details;
- claim keys or payments you haven't genuinely earned, or exploit bugs or errors (report them instead);
- scrape, hack, overload, or interfere with the platform; or
- break any applicable law or platform terms.
Breaking this section can mean immediate suspension, loss of pending earnings tied to the breach, removal from the platform, and for fraud which may include referral to the authorities and recovery of any amounts wrongly paid.
9. Suspension and termination
You can close your account any time by contacting us. Genuinely earned, verified payments above the threshold will be paid in the normal cycle.
We can suspend or close your account, remove content, or withhold payment if you break these Terms, if we reasonably suspect fraud or abuse, if a Studio or platform requires it, or if the law requires it. Where reasonable and the account is in good standing, we'll give notice.
Sections that by their nature should continue (ownership, confidentiality, disclaimers, liability, indemnity, and governing law) survive after your account closes.
10. Disclaimers
Key Claimer is provided “as is” and “as available.” To the fullest extent the law allows, we don't warrant that the platform will be uninterrupted, error-free, or secure, and we don't guarantee any particular keys, campaigns, income, views, or results. We're not responsible for the acts or omissions of Studios, payment providers, or third-party platforms (e.g. Twitch, YouTube, TikTok), or for changes those platforms make.
Nothing in these Terms limits any liability that can't legally be limited (for example, for death or personal injury caused by negligence, or for fraud).
11. Limitation of liability
To the fullest extent permitted by law:
- we are not liable for indirect, incidental, special, or consequential losses, including lost income, lost views, lost data, lost opportunities, or loss of goodwill; and
- our total liability to you for all claims connected with these Terms will not exceed the greater of (a) the total amount we actually paid you in the 3 months before the claim, or (b) £100.
12. You cover us for your actions (indemnity)
You agree to cover us (and reimburse our reasonable costs, including legal fees) for claims, losses, or damages arising from: your content; your use of the platform; your breach of these Terms; your infringement of anyone else's rights; or your breach of any law. This continues after your account closes.
13. Changes to these Terms
We may update these Terms. If a change is significant, we'll give reasonable notice (by email or a notice on the platform) before it takes effect. Continuing to use Key Claimer after that means you accept the update. If you don't agree, you can close your account.
14. General
Governing law. These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, unless local consumer law gives you rights in your own country.
No exclusivity. We don't stop you working with other platforms, Studios, agencies, or directly with anyone.
Whole agreement. These Terms, plus any campaign-specific terms and our Privacy Policy, are the whole agreement between us.
Severability. If part of these Terms is unenforceable, the rest still applies.
No waiver. If we don't enforce something straight away, we can still enforce it later.
Assignment. You can't transfer your rights under these Terms without our consent; we may transfer ours (e.g. in a business sale).
